Truck accident defense following fatal collision

On Behalf of | May 21, 2018 | Truck Accident Defense

In New York and across the country, truck accidents often raise high emotions because of their devastating effects. Litigation related to these accidents can be complex, involving many parties and testimony about technical aspects of a vehicle’s safety features and insurance coverage. Trucking companies, independent drivers and insurance companies may find themselves in need of a skillful truck accident defense, especially if the accident resulted in injuries or loss of life.

One recent accident may be just such an example. A 26-year-old man had pulled his car off the highway when it became disabled around 2:30 a.m. His three passengers, who were between 17, 18 and 19 years old, remained in the car while the driver attempted to get the vehicle running. The car was on the shoulder with its hazard lights flashing when it was struck by a box truck.

The 42-year-old driver of the box truck had apparently drifted out of his lane. The impact of the collision caused fatal injuries to the car driver, who was pronounced dead at the scene. The three young men in the vehicle were not seriously injured but were treated at a New York hospital. Police ticketed the truck driver for an unsafe lane change, but the investigation is still underway.

When an accident results in someone’s death, the victim’s surviving family may be entitled to seek justice through the civil courts. Because a trucker’s insurance policy may carry a high limit, the insurer faces substantial risk during these civil proceedings. When seeking legal defense, insurance companies would benefit from the representation of an attorney who has experience and proven success in truck accident defense.
