Car accident defense in lawsuit more difficult after conviction

Police say they began receiving reports of an erratic driver around 8 p.m. on the evening of Friday, April 20. Before they could locate the pickup truck callers described, the truck had collided with a minivan. Eyewitnesses reportedly told police the pickup truck had crossed the double yellow line into oncoming traffic. The accident closed down both sides of the two-lane highway.

Media reports do not reveal the number or ages of the occupants in the minivan, but police say their injuries were serious and that some may have suffered life-threatening injuries. The 27-year-old driver of the pickup truck was charged with vehicular assault and felony driving while impaired by drugs because of a previous conviction. He was jailed on $25,000 bail.

Facing such serious charges while having previous convictions, the driver in this incident certainly has cause for concern. If the man is convicted, the families of the victims may find it easier to pursue compensation through a personal injury claim against him.
