Truck accident defense beneficial during personal injury lawsuits

On Behalf of | Dec 19, 2017 | Truck Accident Defense

When truck accidents result in critical or fatal injuries, the public may be quick to blame the truck driver. However, there are often extenuating circumstances surrounding an accident of which the public is unaware. A recent accident on a New York highway left two people critically injured. While no charges have been filed, the driver may benefit from the truck accident defense of an attorney, especially if a lawsuit is filed.

In the very early hours of a recent Wednesday, a car became disabled, and the driver pulled off to the shoulder of the road. Sometime later, another vehicle pulled up beside the disabled car in the right lane, presumably to assist the driver of the first car. The 26 and 27-year-old drivers exited their vehicles and walked to the front of the first car. They were standing together when a tractor-trailer struck the second vehicle.

The impact of the collision pushed the second car into the disabled vehicle. The cars then crashed into the drivers, pinning the two beneath the wreckage. Both drivers suffered life-threatening injuries and were taken to a nearby hospital for medical attention. The 30-year-old driver of the tractor-trailer was not injured.

In situations like these, injured parties may attempt to seek restitution through the insurance of the trucking company. There are high limits on truck insurance policies, and a successful lawsuit may result in millions of dollars for a plaintiff. Truck drivers and insurance companies vulnerable to lawsuits may benefit from the assistance of a New York attorney with experience in truck accident defense.
